From 1 July 2010 it is mandatory to prepare the Energy Performance Certificate (APE) not only for the sale of properties but also in the case of leases, finance leases and company leases, whether they are new or renewed, referring to a single real estate unit or multiple real estate units. For the sale the obligation is effective from July 1st 2009.
Certification obligation for leases The contract is finalized as from 1 July 2010.
The contract that has undergone an explicit or tacit renewal starting from 1 July 2010 is considered "renewed". The certificate of energy certification must be delivered to the counterpart, in original or in copy declared compliant: in this way it is possible for the conductor to evaluate, also from an energetic point of view, the congruity between the building being rented and the relative fee .
Penalties: from € 2,500 to € 10,000 for the lessor who does not comply with the obligation to deliver ACE to the tenant.
What is A.P.E. energy certification?
The certificate of energy certification (APE), provided for by the European Directive 2002/91 / EC, is the summary document attesting the results of the energy survey carried out on the building analyzed. It allows the user to evaluate the energy efficiency of the building and at the same time to have a perception of what may be the running costs related to the heating-cooling of the building.
The contents of the A.P.E. energy certificate
The main information reported on ACE is the primary energy requirement for winter heating or air conditioning, EPH, the indicator that, based on the construction characteristics of the enclosure and the installed system types, determines the energy class of the building. Thanks to the comparison with a simple scale made up of eight green colored boxes (low energy requirements) up to red (high demand), all citizens, even non-experts, can immediately understand if a building consumes a lot or little energy. The calculation that makes it possible to determine the EPH of a building is unambiguous and based on a standardized methodology, so as to exclude any subjective interpretation on the part of the person who completes the certification process and does not take into account the real conditions of use of the building.
Duration of the certificate
The certificate of energy certification has a maximum eligibility of 10 years from the date of registration of the practice in the energy cadastre.
